L’Italia equipara siti come Youtube a servizi audiovisivi
Pubblicate le delibere Agcom con le nuove regole web tv e web radio. Una sopresa: anche alcuni siti Ugc (con contenuti generati dagli utenti) dovranno rispettarle
Agcom (Autorità garante delle comunicazioni) ha pubblicato le due attese delibere su web tv/web radio (qui e qui). Il quadro è come avevamo anticipato, ma in più si conferma e chiarisce meglio un aspetto critico: le nuove norme si applicano anche a siti-community con contenuti generati dagli utenti, purché facciano almeno 100 mila euro di fatturato annuo e abbiano un controllo editoriale. E’ possibile che i siti come Youtube, Vimeo e Dailymotion rientrino in questa categoria.
Le nuove regole prevedono una piccola tassa (500 euro), tenere un registro dei propri contenuti, rispettare l’obbligo di rettifica entro 48 ore e i vincoli sulla tutela dei minori, tra le altre cose. Quest’ultimo punto può essere difficile da rispettare per i siti con video on demand, ma si aspettano chiarimenti sulle mdoalità dai futuri regolamenti attuativi Agcom. Il problema è che queste sono state pensate per le tv normali e ora vengono applicate a internet. Lo scarto tra i due mondi richiederà che Agcom spieghi bene come possono i siti adeguarsi a quanto richiesto.
C’è un’altra incognita: forse Youtube e altri siti potranno sfuggire alle nuove norme in quanto hanno una sede legale fuori dall’Italia. Lo si scoprirà nelle prossime settimane.

L'AGCOM ha pubblicato due risoluzioni che ora equiparano video online ai servizi di radiodiffusione, una mossa che porta con sé l'auto-regolazione e potenzialità di intervento del governo-che un broadcaster tradizionale volti in Italia.
