Btjunkie, indagati Fastweb e Ngi
Per la prima volta in Italia, due provider accusati di favorire la pirateria per non aver oscurato il sito torrent BTJunkie. Che comunque resta accessibile via proxy…
Siamo entrati nella fase tolleranza zero per la pirateria online, prova ne è l’iscrizione dei rappresentanti legali di Fastweb e Ngi nel registro degli indagati. E’ la prima volta che capita ai provider italiani. L’ha fatto l’Autorità giudiziaria di Cagliari, perché avrebbe scoperto che i due provider non avrebbero ubbidito all’ordine di aprile di oscurare BtJunkie.
Fastweb parla di “errore tecnico” e assicura che ora blocca l’accesso degli utenti a quel sito. Ngi invece afferma invece che l’errore è della autorità, visto che loro hanno rispettato da subito l’ordine.
La vicenda ha molti lati oscuri, quindi. Probabilmente è eccessivo parlare di favoreggiamento di reato in questo caso. Si noti che l’Italia ha cominciato a oscurare siti torrent appunto per questa fattispecie, “favoreggiamento” (i file illeciti non si trovano su quei siti ma solo sono rintracciabili attraverso di loro, infatti). Il tentativo è quindi notevole: equiparare la responsabilità dei provider inadempienti (o supposti tali) a quella dei siti accusati di un certo reato.
Una cosa certa è che adesso gli operatori saranno più veloci a rispettare gli ordini di oscuramento, anche se probabilmente non servirà a molto. Almeno finché le denunce non riusciranno a bloccare con maggiore rapidità anche i proxy che fanno accedere ai siti bloccati.

BTJunkie indexes both private and public trackers using an automatic web crawler that scans the Internet for torrent files. Cookies are used to track what one downloads so that the person doesn't need to register in order to rate the torrent. The ratings and feedback given by the person are used to help properly filter and flag malicious torrents uploaded onto the website.

Era pure ora che si cominciasse a prendere in considerazione la pirateria online, e dopo la chiusura di Scarico Libero e Magavideo abbiamo visto che fanno sul serio. Ma adesso mi chiedo: dove vediamo i film e scarichiamo i giochi??? Doppia faccia della medaglia.
