Pirateria, riprende la battaglia contro la delibera Agcom
Il 14 settembre è finita la consultazione pubblica sulle nuove norme intorno al copyright e quindi si va verso la fase finale. I contestatori continuano a parlare di gravi rischi per la libertà del web
Comincia l’ultima battaglia intorno alla delibera Agcom sul copyright, che sarà ultimata a novembre. L’attuale testo (provvisorio) è molto più moderato del precedente, dopo le tante proteste (di esperti, associazioni e politici bipartizan), ma i rischi per la libertà di internet ci sono ancora. Lo sostiene il movimento Sito non raggiungibile (di varie associazioni dei consumatori, provider e di Agorà Digitale-Radicali). E’ un parere autorevole, perché sono quelli che hanno scatenato la campagna di protesta contro la delibera.
Hanno mandato ad Agcom i propri commenti formali (qui il documento). In sintesi, rilevano che comunque Agcom si vuole attribuire un potere enorme, in grado di decidere la vita o la morte di siti accusati di pirateria: quello di fare multe molto salate (fino a 250 mila di euro) a chi non rispetta i suoi ordini di rimozione. Il tutto, senza che Agcom abbia una copertura normativa per farlo.
“Riteniamo ingiusto, inopportuno e inappropriato che l’Autorità possa pretendere di regolamentare direttamente ambiti che la Costituzione affida al potere legislativo e al potere giudiziario, che in altri Paesi dell’Unione europea sono stati oggetto di lunghe discussioni parlamentari e con un approccio che, peraltro, in sede comunitaria è stato nettamente rigettato”, si legge nel documento.
“Il diritto d’autore dovrebbe essere regolamentato in modo da garantire che nella sfera digitale ci sia il giusto equilibrio tra i diversi interessi, altrimenti da strumento di promozione della creatività e di nuovi contenuti esso diverrà un sistema di controllo e censura pervasivo e un ostacolo intollerabile all’accesso alla cultura e all’informazione”.
La tesi è radicale: niente modifiche alla delibera, bisogna anzi cassarla e chiedere al Parlamento di rinnovare la normativa sul diritto d’autore. Una riforma è necessaria, infatti. Ma non solo per combattere la pirateria senza cadere in eccessi censori; ma anche per tutelare il fair use contro la scure del copyright. Al momento il fair use non previsto nel nostro ordinamento ed è solo debolmente indicato nel nuovo testo della delibera- notano le critiche. Sarebbe il diritto, ai tempi di internet, di pubblicare senza autorizzazioni un video coperto da copyright se lo scopo è quello di critica, di divulgazione scientifica e se non c’è fine di lucro.
Insomma, nella battaglia tra gli opposti interessi- utenti di internet e copyright- si deve ancora trovare un punto di equilibrio. Ma secondo alcuni solo il Parlamento ci può riuscire. Non un’Authority.
